Terms and Conditions of Sale

Preamble

The website www.ambergris.eu is operated by Ambergris Europe, a company headquartered at Les Quintes, 34600 Taussac-la-Billière, France, and registered with the Béziers Trade and Companies Register under number 838 532 893.

Article 1 – Definitions

  • Buyer: Any individual purchasing products through the website.

  • Seller: Ambergris Europe.

  • Website: www.ambergris.eu

  • Products: Items available for sale on the site, such as raw materials for perfumery, incense, and related accessories.

Article 2 – Scope and Modifications

2.1 These Terms and Conditions define the rights and obligations of both Parties within the framework of online product sales by the Seller to the Buyer.
2.2 They apply to all orders placed through www.ambergris.eu.
2.3 Ambergris Europe reserves the right to amend these Terms at any time. The applicable version is the one in effect on the date of the order.
2.4 The Buyer fully accepts these Terms and Conditions. Any conflicting document from the Buyer will not be applicable unless explicitly accepted by the Seller.

Article 3 – Products and Availability

3.1 Products are offered while supplies last.
3.2 "Made to Order" products are subject to manufacturer approval.
3.3 Product descriptions and photos are as accurate as possible; slight differences may occur and do not affect the validity of the sale.
3.4 If an item is unavailable, the Seller will offer an exchange or refund within 30 days.

Article 4 – Pricing

4.1 All prices are displayed in euros, inclusive of all taxes (VAT), excluding shipping costs.
4.2 The Seller may change prices at any time but will honor those shown at the time of order, subject to product availability.

Article 5 – Payment and Security

5.1 Payments are processed by credit card through the secure, encrypted platform Stripe. No bank information passes through the website.
5.2 The Seller reserves the right to refuse an order in case of an unresolved dispute with the Buyer.
5.3 Product ownership transfers to the Buyer only after full payment is received.
5.4 Product risk transfers to the Buyer upon delivery.

Article 6 – Order Confirmation

6.1 By confirming the order, the Buyer accepts these Terms without reservation.
6.2 The Buyer must provide accurate and honest information in the online forms.
6.3 The Seller may contact the Buyer to verify submitted data. A valid email address and phone number are mandatory.
6.4 Orders may be suspended due to payment issues, incorrect addresses, or other account-related problems.

Article 7 – Shipping and Delivery

7.1 Deliveries are made via postal service or an independent courier to the address specified by the Buyer.
7.2 Shipping costs are included in the total order amount based on the option chosen.
7.3 Orders are processed within 5 business days after confirmation.
7.4 Delivery times are indicative and calculated in business days from the shipping date.

Preorders: Estimated delivery times are shown on product pages and may vary depending on production volume. Ambergris Europe is not liable for delays caused by third parties or force majeure.

7.5 If the courier fails to deliver, the Seller will resend items under the terms of these conditions.
7.6 The Buyer must inspect the goods before signing the delivery receipt.
7.7 If packaging is damaged upon delivery, the Buyer must inspect the contents. If damaged, the parcel should be refused with the note: "Parcel refused – opened or damaged."
7.8 Buyer information is required for order processing and may be shared with Ambergris Europe’s delivery partners.

Article 8 – Right of Withdrawal and Returns

8.1 Exchanges (France only)

  • The Buyer may request an exchange within 14 days of delivery.

  • A prepaid return label will be sent via email.

  • The delivery slip must be included in the return.

  • For returns outside mainland France, the Buyer must arrange and pay for shipping to:

  • After verification, the product will be exchanged.

  • For deliveries outside France, return shipping costs apply.

8.2 Refunds

  • Same process and 14-day window.

  • The prepaid return label cost (France only) will be deducted from the refund.

  • Refunds are issued within 30 days of receiving the returned item.

  • Returned products must be unused, in original condition, and in undamaged packaging.

  • If the product is not in resellable condition, no refund will be issued, and it will be returned to the Buyer at their expense.

Exclusions:
As per Article L121-21-8 of the French Consumer Code, items made to the Buyer's specifications or clearly personalized, as well as incense sticks and products marked “Made to Order”, are non-refundable.

Article 9 – Severability

If one or more provisions of these Terms are deemed invalid or declared as such by law or a final court decision, the remaining provisions shall remain fully applicable.

Article 10 – Governing Law and Dispute Resolution

These Terms and Conditions are governed by French law.
In the event of a dispute, the Buyer agrees to seek an amicable solution by contacting the Seller before initiating legal proceedings.
